Welcome to Charmie Galaiya. These terms explain how this website works, how a commission with the atelier is placed and fulfilled, and what each of us is responsible for along the way.
They are written to be read, not to be skimmed past — particularly how ordering works and the returns position on made-to-order couture, which are the two that most often surprise people. Please read them alongside our Privacy Policy.
1.About These Terms
These Terms & Conditions govern your use of labelcharmiegalaiya.in and labelcharmiegalaiya.com (the “website”) and any enquiry or commission you place through it. Both addresses are operated by the same house and carry the same catalogue and the same terms.
Throughout this document, “Charmie Galaiya”, “the house”, “the atelier”, “we”, “us” and “our” mean Label Charmie Galaiya, operating from Mumbai, Maharashtra, India. “You” and “your” mean any person using the website or dealing with the atelier through it.
By browsing this website or contacting us through it, you accept these terms together with our Privacy Policy. If you do not accept them, please do not use the website.
2.How Ordering Works — This Is an Enquiry-Led Atelier
This website is a catalogue and a look-book, not a shop. There is no cart and no checkout. Nothing shown here can be bought by clicking a button, and no contract is formed by browsing.
The sequence is always the same:
- You enquire — through the enquiry form, by email, by phone or by using an “Enquire to Buy” button, which opens WhatsApp with the details of the piece pre-filled.
- We respond — confirming availability, the final price for your specification, any customisation you have asked for, the measurements we need and a realistic delivery date.
- You confirm — a commission becomes binding only when we have agreed the specification, the price and the timeline in writing with you, and the agreed advance has been received. Until that point either side may walk away with no obligation.
Prices, availability and lead times quoted on this website are an invitation to enquire, not an offer capable of acceptance. We reserve the right to decline any enquiry or commission.
3.Payments
No payment is ever taken on this website and we never ask for card, UPI or bank details through it. There is no payment page, no stored card and no payment gateway embedded in these pages. If you are ever asked to pay through a page that appears to be ours, do not pay — contact us on the number below first.
Payment for a commission is arranged directly with the atelier once the specification is agreed, through the channels we confirm with you in writing. Made-to-order work customarily begins on receipt of an agreed advance, with the balance due before dispatch. The exact schedule is confirmed for each commission.
Prices on this website are quoted in Indian Rupees (INR) and are exclusive of shipping, insurance and any duties or taxes payable in the destination country.
4.Made-to-Order Work, Lead Times and Fit
Every piece the house makes is made to order. Nothing is held in stock; your garment is cut, embroidered and finished for you after you commission it.
- Lead time. Lighter pieces are typically ready in 2–3 weeks and heavily embroidered bridal lehengas in 4–5 weeks. The precise timeline is confirmed at the time of enquiry. Lead times run from the date the specification and advance are confirmed, not from the date of first contact.
- Sizing. Pieces are made in standard sizes XS–XXL or custom-tailored to your own measurements. For custom work we provide a measurement guide and offer virtual fitting consultations. Measurements you supply are your responsibility; a garment cut correctly to measurements that were given incorrectly is not a fault.
- Hand craft. Aari, zardozi, dabka, cutdana, pearl and crystal work are executed by hand. Small variations in placement and density between one piece and another, and between a piece and its photograph, are inherent to hand craftsmanship and are not defects.
- Delays outside our control. We are not liable for delays caused by events beyond our reasonable control, including courier and customs delays, transport disruption, strikes, natural events or the unavailability of a specific fabric or material. Where one arises we will tell you promptly and agree a revised date.
5.Cancellations, Returns and Alterations
Because every garment is made specifically for you, custom and made-to-order pieces are non-returnable, non-exchangeable and non-refundable once production has begun. This is the single most important term on this page, and we would rather you knew it before you commission than after.
It is also why we work the way we do: we confirm the colour, the fabric, the embroidery, the silhouette and every measurement with you in writing before a single stitch is made, and we welcome as many questions as you need to ask first.
- Cancellation before production. If you change your mind before we have begun cutting or embroidery, tell us at once and we will do what we reasonably can, including discussing what portion of any advance can be returned.
- Manufacturing faults. If a piece reaches you with a genuine manufacturing defect, or is materially not what was agreed, tell us within 48 hours of delivery with photographs. We will inspect it and repair, remake or otherwise put it right at our cost.
- Alterations. Fit adjustments after delivery are handled case by case. We will always try to help; shipping both ways for a post-delivery alteration is normally borne by the customer.
- Not defects. Slight variation in shade between screens and cloth, the natural irregularity of hand embroidery, and a fit issue arising from measurements supplied incorrectly are not grounds for return.
6.Shipping, Duties and Delivery
- Where we ship. We ship worldwide, to over 25 countries, by insured courier.
- Duties and taxes. Import duties, customs charges and local taxes levied by the destination country are borne by you, not by us. They vary by country and are outside our control. Refusal to pay them, resulting in the parcel being returned or destroyed, is not a ground for refund.
- Address accuracy. Please check the delivery address you give us. We are not responsible for a parcel delivered correctly to an address you supplied incorrectly.
- Risk. Risk in the garment passes to you on delivery to you or to a person at the delivery address.
7.Product Information, Colour and Pricing
We take real care over the accuracy of the descriptions, photographs, measurements, fabric and embellishment details and prices shown here. Even so:
- Colours will not render identically on every screen. A photograph is a guide, not a colour match. If shade is critical to you, ask us for a swatch or a video before you commission.
- Fabric and embroidery details are stated to the best of our knowledge for each piece; where a specification is confirmed for your commission, that written confirmation prevails over the catalogue page.
- Prices shown are starting prices for the piece as photographed. Customisation, a change of fabric, additional handwork or non-standard measurements may change the price, and we will always tell you before proceeding.
We reserve the right to correct any error, inaccuracy or omission on this website, and to change prices, specifications or availability at any time without prior notice. Where a piece has already been confirmed with you in writing, the confirmed terms stand.
8.Intellectual Property
Everything on this website — the designs and garments themselves, the product and campaign photography, the look-books, the artwork, the written copy, the logo and word-mark, the layout and the code — is the property of Label Charmie Galaiya or its licensors, and is protected by Indian and international copyright, design and trade mark law.
You may browse the site and share links to it. You may not:
- copy, reproduce, republish, distribute or commercially exploit any of its content without our prior written consent;
- use our photographs or look-books in your own listings, catalogues, advertising or social media as though they were yours;
- reproduce, adapt or manufacture any design shown here, whether or not for sale;
- use our name, logo or word-mark in a way that suggests an association, endorsement or stockist relationship that does not exist;
- scrape, mirror or systematically extract the site's content or images by any automated means.
You may not link to this website from another site, publication or platform in a way that implies endorsement or association without our prior written permission. Unauthorised use may be pursued as an infringement of our rights.
9.Acceptable Use of the Website
You agree not to:
- use the website for any unlawful purpose, or in a way that infringes anyone else's rights;
- attempt to gain unauthorised access to the website, its hosting or any connected system;
- introduce malware, or interfere with the site's operation or availability;
- submit false, misleading or impersonating information through our forms, or send us content that is unlawful, defamatory or offensive.
Any content you submit through an enquiry — including an inspiration image — must be yours to send. By sending it you confirm that you have the right to do so and that we may use it for the purpose of responding to and fulfilling your enquiry.
10.Third-Party Services and Links
This website links to and embeds third-party services — WhatsApp for enquiries, Instagram, Facebook and Pinterest for our social channels, an embedded map on the contact page, and Google’s analytics tools. Those services are operated by others under their own terms and privacy policies, and we neither control nor endorse their content or practices. Links to any other website are provided for convenience only. See our Privacy Policy for what data those services receive.
11.Disclaimers and Limitation of Liability
This website and its content are provided on an “as is” and “as available” basis. While we work to keep it accurate and available, we do not warrant that it will be uninterrupted, error-free or free of harmful components, and your use of it and reliance on any information here is at your own discretion.
To the fullest extent permitted by law, Label Charmie Galaiya shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, opportunity, data or goodwill, arising out of your use of this website. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by negligence, or for fraud.
Where liability in relation to a commission is established, it is limited to the amount you actually paid to us for the garment concerned.
12.Changes to These Terms
We may revise these Terms & Conditions from time to time to reflect changes in how the house operates or in the law. The current version is always the one published on this page, and the “Last updated” date at the top tells you when it last changed. Continuing to use the website after a change means you accept the revised terms. Commissions already confirmed in writing remain governed by the terms in force when they were confirmed.
13.Governing Law and Jurisdiction
These Terms & Conditions, and any dispute or claim arising out of or in connection with them, this website or a commission placed through it, are governed by and construed in accordance with the laws of India. Subject to any right you may have to approach a consumer forum under the Consumer Protection Act, 2019, the courts at Mumbai, Maharashtra, India shall have exclusive jurisdiction.
